New York Enacts Nation’s First Statewide Moratorium on Large-Scale Data Centers

ALBANY, N.Y. — New York has become the first state in the nation to enact a statewide moratorium on the construction of new large-scale data centers.
Gov. Kathy Hochul signed an executive order placing a one-year pause on the largest data center projects while the state evaluates their impact on energy demand, the environment, electric grid reliability, and local communities.
State officials say the pause will allow New York to study how the rapid growth of artificial intelligence and cloud computing is affecting the state’s energy infrastructure before approving additional large-scale developments.
The move has sparked political debate across the state.
Supporters say the temporary moratorium gives New York time to create responsible policies that balance technological growth with environmental protection and energy reliability.
Critics, including Republican lawmakers and some business leaders, argue the pause could discourage investment, cost New York jobs, and send technology companies to other states offering incentives for data center development.
The executive order will remain in effect for one year while state agencies complete their review and develop recommendations for the future of large-scale data center construction in New York.
